Terms of trade

National FMCG is a trading name of 8t Ltd. These terms apply to all sales of goods by 8t Ltd ("we", "us") to business customers ("you").

Trade only

We sell to businesses only. By opening an account or placing an order you confirm that you are buying in the course of a business and not as a consumer. We may ask for evidence of your business before accepting an order.

Orders and prices

  • Stock lists, quotes and offers are subject to availability until we confirm your order in writing.
  • Prices are in pounds sterling and exclude VAT, duty and delivery unless we state otherwise.
  • For export orders, the Incoterm on your order confirmation sets out who pays for carriage, insurance and duties, and when risk passes.

Payment

Unless we have agreed credit terms in writing, payment is due in cleared funds before goods are released or loaded. Title to the goods stays with us until we have received payment in full.

Delivery and collection

Delivery dates are estimates. Risk passes to you on delivery, on collection, or as set out by the agreed Incoterm. Check goods on arrival and note any shortage or visible damage on the delivery paperwork.

Short dated and clearance stock

Short dated, end of line and clearance stock is sold as described on the offer, including the best before or expiry dates shown. It is your responsibility to sell it within its date and in line with the law that applies where you sell it.

Claims

Tell us about any shortage, damage or incorrect goods in writing within 48 hours of delivery or collection. Our liability for any claim is limited to the price of the goods concerned. Nothing in these terms limits liability that cannot be limited by law.

Compliance

You are responsible for meeting any licensing, labelling and import requirements in the country where you resell the goods, unless we have agreed in writing to handle them.

Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
